Laois Stone & Stoves Terms and Conditions

It is your responsibility to read these terms and conditions for your records. We reserve the right to change these Terms & Conditions at any time.

Goods:
All Goods are subject to availability. We will inform you by phone call/email/phone message as soon as possible if the product you have ordered is not available and we will not process your order.
Laois Stone accepts no responsibility for changes in specification or any other changes made by a manufacturer.

Prices:
All Goods are priced in Euro, prices include VAT and delivery when agreed/ticked at the time of purchase
We endeavour to ensure all our prices are correct. In the event of any error, we will make you aware of the correct price before the processing of your order. We will be happy to cancel the order process if you no longer wish to proceed in this case.
Prices for our products may change from time to time, but changes will not affect any order which we have confirmed with an email confirmation.

Placing Your Order:
Please check your order and amend any errors before submitting your order to us.
After your payment has been processed, we will give you an order acknowledgement Receipt/Invoice detailing the products you have ordered.

Collection of “Goods”:
It is the customer’s responsibility to check goods at the pick-up location (the LSSupplies warehouse or Shop) for the quality of the product, any sustained damage, colour variation, product size and measurements, product finish and appearance.

Delivery:
All Goods must be paid for in full before dispatch.
Personal cheques can be accepted but must have been cleared in our bank account before the dispatch of the goods.
All Goods must be signed for on receipt of delivery. The driver will wait while you check that your stove has been delivered in perfect condition.
No complaints about damaged Goods will be handled if we hold a signature as proof of perfect delivery
We are not responsible for faults that may occur with your Goods due to negligent fitting. We recommend that a qualified HETAS installer does this for you and follows all the correct installation guidelines so that you can enjoy your Goods to the maximum.
Manufacturers’ faults are not our responsibility but we will, however, try our very best to support a problem you may have with faulty Goods. All of our goods come with a manufacturer’s warranty. Couriers do not deliver Goods to second-floor premises or any property that will cause undue hardship to the delivery driver. You must inform us if you think that your delivery will prove difficult.

Delivery Delays:
According to the Consumer Contracts Directive, the goods ONLY need to be delivered within 30 days, to be seen as delivered on time.
We can’t assume responsibility and don’t accept liability for delayed, failed, or late courier deliveries. However, we will assist our customers to track/enquiring and getting the latest delivery update from the courier upon the customer’s request.

Pallet Deliveries:
Pallet deliveries are made to a kerbside location. If there is an accessible delivery point that can be safely accessed by the delivery driver using a pump truck then, at the delivery driver’s absolute discretion, the pallet may be left there.
Unlike parcels, palletized goods are by their nature larger items that cannot easily be moved. This is not a two-man delivery service and the delivery driver has to operate within health and safety guidelines. They are under no obligation to enter the delivery premises to deliver the goods to a location that the recipient may feel is more suitable.
As the pallet will be moved by a manually operated pallet truck, we cannot collect or deliver pallets on gravel drives, steep hills, or to locations not at ground level.
You should ensure that the named contact is available at the delivery point to meet the driver.

Storage of the “Goods”:
Storage Duration: Customer purchased “Goods” will be stored in our warehouse for a maximum of 30 calendar days from the date of receipt. In case the “Goods” are left uncollected after the 30 calendar days storage period, the “Goods” will be considered abandoned, and Laois Stone & Stoves reserves the right to re-sell the “Goods” without further notice and the purchase amount will be refunded to Customers account upon presentation of a valid purchase receipt.

Extended Storage: Upon expiration of the 30-day storage period, the customer has the option to extend storage time at an additional cost of €1 plus VAT per pallet per calendar day (customer must contact Laois Stone and Stoves, subject to storage space availability).

Liability: By utilizing the “Goods” storage service, customers agree to adhere to these Terms and Conditions. The Laois Stone and Stoves reserves the right to amend these terms without prior notice to customers.

Damages:
Our “Goods” are checked and deemed in excellent condition before leaving our warehouse. Customers must inspect the “Goods” immediately upon arrival and DO NOT sign for the unchecked/un-inspected “Goods”. Sign ONLY checked/inspected “Goods” when you are certain that they have arrived in perfect condition. PLEASE NOTE: if the “Goods” are signed but arrived damaged, the insurance claim CAN NOT be preceded and we CAN NOT assume liability for the damage or submit the insurance claim.

Product Colour Accuracy:
The product colours/shades i.e. cladding stone, mantel beams, enamel stove finish, sleight hearths, etc shown on our website are for guidance only and will vary depending on monitor and browser type. All colours/shades shown should not be taken as a representation of the true colours/shades or finishes of the products.
In addition, the colours/shades represented in the products available on our website may vary in colour or finish between product ranges and/or suppliers or from variations in colour or finish between or within batches of products from the same supplier.
It is always recommended that a visual check of colour is made before any major purchase and in many cases, the customer can view or discuss needs as well as order a FREE product sample online.
Please note that Cladding Stone colours can/do change “batch to batch” including Sample panels.

Returns or Cancellation of your Product:
If Goods have already been delivered to you, you have a period of 7 days in which you may cancel and return your product.

To cancel a contract, you must contact us in writing by sending an email to laoisstone@gmail.com
We will process the refund due to you as soon as possible, and in any case, within 30 days of the day on which you emailed us notice of cancellation.

Returns and Exchange Policy
Laois Stone and Stoves will return or exchange standard stock items that are in new condition. There is a 14 consecutive day cooling off period whereby standard stock products may be returned. After 7 consecutive days, we will impose a 15% handling and re-stocking charge on items returned or exchanged. All items must be accompanied by the returns form available online, evidence of original purchase from Laois Stone and Stoves, and in the original undamaged packaging.
Goods that are non-stock items and goods which have been specially ordered will not normally be accepted by way of return for credit.

(a) Standard Stock Products
Laois Stone and Stoves shall not be obliged to accept normal stock goods returned for credit but may at its absolute discretion do so.
In the case of delivered orders, the cooling-off period begins at the point of delivery. In the case of orders collected at Laois Stone and Stoves, the cooling-off period begins at the point of collection.
All such goods returned for credit must be accompanied by evidence of original purchase from Laois Stone and Stoves and in the original undamaged packaging.
Any goods which are returned for credit shall not be regarded as having been accepted by Laois Stone and Stoves until Laois Stone and Stoves have issued a formal credit note through the channels laid down for such transactions.
The uplifting by Laois Stone and Stoves’ own vehicles or courier’s vehicles of goods for which credit is sought and for which the lorry driver may issue a receipt note is not an acceptance by Laois Stone and Stoves of liability for credit.
The goods returning to Laois Stone and Stoves by the customer’s own courier at the customer’s own cost, it is the customer’s responsibility and duty to take reasonable care of all goods returned. Returns will not be accepted without prior acknowledgement from Laois Stone and Stoves. Returns must be accompanied by all relevant customer contact details and the Laois Stone and Stoves Returns Form (NOTE: Attach Returns Form to all Returns, Download form HERE). If the goods are damaged upon arrival at the Laois Stone and Stoves warehouse or showroom, Laois Stone and Stoves will contact the customer directly to enable the customer to make a claim against their own courier.
Laois Stone and Stoves strongly advise all customers to take out insurance with their own courier when returning goods. If goods are damaged upon receipt, Laois Stone and Stoves will not refund or exchange the goods and the customer may still be subject to a handling fee.
NOTE: Original purchase delivery and/or return Fee is NOT refundable.

(b) Specially Made Products
Products that have been specially made may not be returned under any circumstances.

(c) Non-Standard Products
Items not stocked by Laois Stone and Stoves but standard to our suppliers will be accepted for a return only if they have been authorized for onward return to the supplier and must be accompanied by evidence of original purchase from Laois Stone and Stoves in the original undamaged packaging.

Any goods which are returned for credit shall not be regarded as having been accepted by Laois Stone and Stoves until Laois Stone and Stoves have issued a formal credit note through the channels laid down for such transactions.
Any credit given in such circumstances will be net of both our own and the supplier’s restocking charges and delivery cost to the country of origin if goods were sent for the customer from outside ROI.

Pellet Stove Warranty Repair Service:
All pellet stoves are supplied with a two-year manufacturer’s parts ONLY warranty (subject to usage conditions). If goods develop a manufacturing fault within the warranty period, we will either test the product(s) in our distribution centre or send them back to the manufacturer to confirm the fault. It is the customer’s responsibility to take care of stove delivery to our distribution centre. Stove return must be accompanied by all relevant customer contact details and the Laois Stone & Stoves Returns Form (NOTE: Attach Returns Form to all Returns,  Download form HERE). If the stove comes damaged upon arrival at Laois Stone & Stoves warehouse, we will contact the customer directly to enable the customer to make a claim against their own courier.
Please allow up to 21 days for testing in our distribution centre, or six weeks with the manufacturer. Once the fault has been established by either our repair team or the manufacturer, the product(s) will be repaired for you as quickly as possible. If we are unable to repair or replace the product(s), we will offer you an alternative closest stove option (subject to the conditions). If no fault is found, a re-delivery charge will be payable by the customer.

Installation Services:
Please note that as a shop/retailer, we do not provide stove, flue, or system installation service, but for our customers, we can recommend HETAS-certified stove installers who have received positive customer reviews over the years of their installations. At the same time, please note that we cannot be held responsible for the work that they carry out –  it’s up to the “Customer and Installer” to agree to installation/removal/service terms and conditions.

How To Pay:
You can only pay for your Goods with cash, credit/debit card at the till or on our website via Pay Pal, Stripe, or through a phone call via credit/debit card.
Goods must be paid in full before confirmation of the order takes place.

Age of Consent:
When placing an order you are declaring that you are 18 of age or older and that the person accepting the delivery also fits these criteria.

Warranty for Goods:
There is a manufacturer’s warranty on all Goods. Manufacturing faults are not our responsibility; however, we will assist where we can.
It is recommended that all Goods are fitted/installed by a HETAS installer. Proof of this will be needed should the occasion arise.
